Introduction

Welcome to Shoot with Blu ("we," "our," or "us"). These Terms and Conditions govern your use of our photography and modeling services platform located at shootwithblu.com (the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

Services Description

Shoot with Blu provides a platform connecting photographers, clients, and models for professional photography services including:

  • Professional model bookings and management
  • Photography session scheduling and coordination
  • Moodboard creation and visual concept development
  • Payment processing and financial management
  • Portfolio management and image hosting

User Accounts and Registration

To access certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Booking and Cancellation Policy

Booking Confirmation

All bookings are confirmed only after full payment is received. We reserve the right to cancel bookings in case the brand doesnt align with out asthetic. In that case refund will be processed within 7-10 business days.

Payment Terms

Payment Methods

We accept payments through Razorpay, including credit/debit cards, UPI, net banking, and digital wallets. All payments are processed securely through our payment gateway.

Pricing

  • All prices are in Indian Rupees (INR) and include applicable taxes
  • Prices are subject to change with 30 days notice
  • Additional services may incur extra charges
  • Travel expenses apply for locations outside Mumbai

Installment Schedule

  • 30% Booking Deposit: due immediately to confirm and block the shoot date.
  • 50% Pre-Shoot Payment: due 1 day before the shoot; unpaid balances pause production.
  • 20% Post-Shoot Payment: due within 24 hours after the shoot and before any deliverables are released.

Late payments accrue a 1% interest per day and deliverables are held until the schedule is met.

Intellectual Property Rights

Photography Rights

All photographs taken during sessions remain the property of Shoot with Blu unless otherwise agreed in writing. Clients receive usage rights as specified in their booking package.

Model Releases

Models must sign a model release form granting permission for the use of their images. Usage rights are limited to the terms specified in the release form.

Platform Content

All content on our platform, including text, graphics, logos, and software, is owned by Shoot with Blu and protected by copyright laws.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the Information Technology Act, 2000 and the Personal Data Protection Bill, 2019 (when enacted) regarding the collection, use, and protection of personal data.

Limitation of Liability

Shoot with Blu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our services.

Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim.

Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through:

  1. Negotiation: Parties shall attempt to resolve disputes through good faith negotiation
  2. Mediation: If negotiation fails, parties shall attempt mediation through a neutral third party
  3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in Mumbai, India
  4. Court: Only if arbitration is not available, disputes may be brought to courts in Mumbai, India

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the new Terms.
